HOT ROD TRUCK GIVEAWAY OFFICIAL SWEEPSTAKES RULES 1. NO PURCHASE, CONTRIBUTION OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. The Hot Rod Truck Giveaway Sweepstakes ("Sweepstakes") begins at 12:00:01 AM Central Time on February 2, 2008 and ends at 11:59:59 PM Central Time on September 30, 2008. 2. ELIGIBILITY: The Sweepstakes is open to legal residents of one of the 50 United States or the District of Columbia (excluding Guam, Puerto Rico, and all other U.S. and foreign territories and possessions) (the "Eligibility Area") who are 18 years of age or older at the time of entry and have the ability to enter into valid contracts in their personal jurisdiction of residence. Only individuals may enter; no entry form from any corporation or other entity shall be accepted. To accept the prize, the winner must be a licensed driver and assume responsibility for registration, title, license, taxes, insurance fees and any other options not expressly included. The Sweepstakes is VOID outside of the Eligibility Area and where otherwise taxed, prohibited or restricted. Employees and directors of RTM Productions, Inc. ("RTM"), its affiliates, subsidiaries, advertising, promotion, fulfillment, marketing agencies, public relation firms, consultants and contractors, their immediate families (defined as spouse, child, sibling, parent or grandparent) and those living in their same households are ineligible to participate in the Sweepstakes. By participating, you agree to these Official Rules and to the decisions of RTM, which are final and binding in all respects. 3. HOW TO ENTER: To enter online, visit the PowerBlockTV.com website and complete and submit all required registration information. All entry information must be complete to qualify. No changes to any entry materials or information are permitted once the entry has been submitted. All entries become the property of RTM and will not be acknowledged or returned. LIMIT ONE ENTRY PER PERSON PER EMAIL ACCOUNT PER WEEK. Entries received by RTM after the end of the Sweepstakes Period will be discarded and deemed VOID. In the event of a dispute as to who submitted an online entry, the individual who was, at the time of entry (in RTM's sole discretion), the registered holder of the email account used to enter the Sweepstakes, will be deemed the eligible entrant. Proof of entering the Sweepstakes online will not be deemed to constitute proof of delivery or receipt of entry. A winner will be chosen by random drawing and announced on or about October 15, 2008 and notified by mail or email. The prize award is subject to verification. 4. ALTERNATE MEANS OF ENTRY: You may also enter by visiting the TrucksTV.com website and completing and submitting all required registration information. The odds of winning the prize will be the same by alternate means of entry as by entry through the PowerBlockTV.com website. 5. ODDS OF WINNING; PRIZE: Odds of winning are determined by and depend upon the total number of eligible entries received. A purchase will not improve your chances of winning. A total of one (1) prize will be awarded. The winner will be awarded a replica of a '37 Pickup truck supplied by Legends Motors and one (1) custom Gibson guitar with one (1) amplifier. The vehicle will have up to 2,500 miles. The approximate value of the prize is $55,000 USD. The value of the prize set forth above represents RTM's good-faith determination of the retail value thereof. The prize may not be combined with any other offer. Winner will be solely responsible for registering and titling the vehicle and for all applicable taxes, fees, insurance and/or any other expenses associated with acceptance and/or taking delivery of the prize. The winner must take delivery of the prize on November 11, 2008 at RTM Productions, Inc., 130 Southeast Parkway Court, Franklin, TN 37064. By accepting the prize, the winner waives the right to assert, as a cost of winning said prize, any and all costs of redemption or travel to redeem said prize, and any and all liability that might arise from redeeming or seeking said prize. The winner accepts sole responsibility for titling and registering the vehicle. The winner acknowledges that he or she shall be solely responsible for ensuring the vehicle complies with his/her state and local motor vehicle regulations, including all safety and emissions regulations. 6. PRIZE AWARDING: THE PRIZE WILL BE AWARDED. The prize will be awarded only upon winner validation and verification by RTM. No substitution, transfer or assignment of the prize is permitted. No substitution of the prize will be permitted, except that RTM reserves the right, in its sole discretion, to substitute the prize with either the cash value of the prize that would have been awarded, or a prize of equal or greater value. RTM will use commercially reasonable efforts to contact the winner by email within fourteen (14) days after the actual date of RTM's selection of the winner. If the initially selected winner cannot be contacted, is ineligible, or fails to claim the prize, the prize will be forfeited and an alternate winner will be selected. Where permitted by law, entrants grant RTM and its affiliates the right to use and publish their proper name and state of residence in connection with the Sweepstakes. Acceptance of the prize constitutes permission for RTM and its affiliates to use the winner's name, likeness and biographical information for advertising and promotional purposes without compensation, unless otherwise prohibited by law. The winner will be required to sign an affidavit of eligibility and liability/publicity release of all parties within five (5) days of notification (or return the signed forms within five (5) days of receipt). DISQUALIFICATION: The use of robotic, automatic, macro, programmed or like methods (including without limitation the use of any promotion/sweepstakes subscription, notification, entry or like sites or service that offers sweepstakes entry services "on behalf of" entrant) is strictly prohibited. RTM is not responsible for lost, interrupted or unavailable network server or other connections, miscommunications, failed telephone or computer or telephone transmissions or technical failure, jumbled, scrambled or misdirected transmissions, or other error of any kind whether human, mechanical or electronic. Persons found tampering with or abusing any aspect of this Sweepstakes, as solely determined by RTM, will be disqualified.
