CHERRY BOMB CHARGER SWEEPSTAKES OFFICIAL RULES NO PURCHASE, CONTRIBUTION OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. The Cherry Bomb Charger Sweepstakes (“Sweepstakes”) begins at 12:00:01 AM Central Time on June 6, 2008 and ends at 11:59:59 PM Central Time on November 7, 2008. ELIGIBILITY: The Sweepstakes is open to legal residents of one of the 50 United States or the District of Columbia (excluding Guam, Puerto Rico, and all other U.S. and foreign territories and possessions) and all provinces of Canada (excluding Quebec) (the “Eligibility Area”) who are 18 years of age or older at the time of entry and have the ability to enter into valid contracts in their personal jurisdiction of residence. Only individuals may enter; no entry form from any corporation or other entity shall be accepted. To accept the prize, the winner must be a licensed driver and assume responsibility for registration, title, license, taxes, insurance fees and any other options not expressly included. The Sweepstakes is VOID outside of the Eligibility Area and where otherwise taxed, prohibited or restricted. This sweepstakes is administered by RTM Productions, Inc. Employees and directors of RTM Productions, Inc. (“RTM”) and Maremont Corporation (“Cherry Bomb”), their affiliates, subsidiaries, advertising, promotion, fulfillment, marketing agencies, public relation firms, consultants and contractors, their immediate families (defined as spouse, child, sibling, parent or grandparent) and those living in their same households are ineligible to participate in the Sweepstakes. By participating, you agree to these Official Rules and to the decisions of RTM, which are final and binding in all respects. HOW TO ENTER: To enter online, visit the PowerBlockTV.com website and complete and submit all required registration information. All entry information must be complete to qualify. No changes to any entry materials or information are permitted once the entry has been submitted. All entries become the property of RTM and will not be acknowledged or returned. LIMIT ONE ENTRY PER PERSON PER EMAIL ACCOUNT PER WEEK. Entries received by RTM after the end of the Sweepstakes Period will be discarded and deemed VOID. In the event of a dispute as to who submitted an online entry, the individual who was, at the time of entry (in RTM’s sole discretion), the registered holder of the email account used to enter the Sweepstakes, will be deemed the eligible entrant. Proof of entering the Sweepstakes online will not be deemed to constitute proof of delivery or receipt of entry. A winner will be chosen by random drawing and announced on or about November 10, 2008 and will notified by mail or email November 11, 2008. The prize award is subject to verification. ODDS OF WINNING; PRIZE: Odds of winning are determined by and depend upon the total number of eligible entries received. A purchase will not improve your chances of winning. A total of one (1) Grand Prize will be awarded. The Grand Prize winner will be awarded a 2006 Cherry Bomb customized Dodge R/T Sedan. Vehicle will have approximately 15,000 miles. The approximate retail value of the Grand Prize is $25,000 USD. A total of four (4) First Prizes will be awarded. Each First Prize winner will be awarded one Cherry Bomb cat-back exhaust system selected from the current Cherry Bomb catalog. Approximate retail value of each First Place prize: $500. A total of two (2) Second Place Prizes will be awarded. Each Second Place Prize consists of Cherry Bomb apparel. Approximate retail value: $350. The value of the prizes set forth above represents RTM’s good-faith determination of the retail values thereof. The prizes may not be combined with any other offer. Grand Prize winner will be solely responsible for registering and titling the vehicle and for all applicable taxes, fees, insurance and/or any other expenses associated with acceptance and/or taking delivery of the prize. The winner must take delivery of the prize on January 7, 2009 at RTM Productions, Inc., 130 Southeast Parkway Court, Franklin, TN 37064. First and Second prizes will be shipped to winners. By accepting the Grand Prize, the winner waives the right to assert, as a cost of winning said prize, any and all costs of redemption or travel to redeem said prize, and any and all liability that might arise from redeeming or seeking said prize. The winner accepts sole responsibility for titling and registering the vehicle. The winner acknowledges that he or she shall be solely responsible for ensuring the vehicle complies with his/her state and local motor vehicle regulations, including all safety and emissions regulations. 6. PRIZE AWARDING: THE PRIZES WILL BE AWARDED. The prizes will be awarded only upon winners validation and verification by RTM. No substitution, transfer or assignment of the prizes are permitted. No substitution of the prizes will be permitted, except that RTM reserves the right, in its sole discretion, to substitute the prizes with either the cash value of the prize that would have been awarded, or a prize of equal or greater value. RTM will use commercially reasonable efforts to contact the winner by email within one day after the actual date of RTM’s selection of the winner. If the initially selected winners cannot be contacted, are ineligible, or fail to claim prizes, the prizes will be forfeited and an alternate winner(s) will be selected. Where permitted by law, entrants grant RTM and its affiliates the right to use and publish their proper names and states of residence in connection with the Sweepstakes. Acceptance of the prizes constitutes permission for RTM and its affiliates to use the winner’s names, likenesses and biographical information for advertising and promotional purposes without compensation, unless otherwise prohibited by law. The winner will be required to sign an affidavit of eligibility and liability/publicity release of all parties within five (5) days of notification (or return the signed forms within five (5) days of receipt). Because of the unique nature and scope of the Sweepstakes, RTM reserves the right, in addition to those other rights reserved herein, to modify any date(s) or deadline(s) set forth in these Official Rules or otherwise governing the Sweepstakes. 7. WINNER: The prizewinner’s name will be posted on the PowerBlockTV.com website on or about November 11, 2008. The winner’s names may also be obtained by sending a self-addressed, stamped envelope for receipt by November 11, 2008 to: RTM Productions, Inc., 130 Southeast Parkway Court, Franklin, TN 37064. 8. DISQUALIFICATION: The use of robotic, automatic, macro, programmed or like methods (including without limitation the use of any promotion/sweepstakes subscription, notification, entry or like sites or service that offers sweepstakes entry services “on behalf of” entrant) is strictly prohibited. RTM is not responsible for lost, interrupted or unavailable network server or other connections, miscommunications, failed telephone or computer or telephone transmissions or technical failure, jumbled, scrambled or misdirected transmissions, or other error of any kind whether human, mechanical or electronic. Persons found tampering with or abusing any aspect of this Sweepstakes, as solely determined by RTM, will be disqualified. If disqualified for any of the above abuses, RTM reserves the right to terminate the person’s eligibility to participate in this and future Sweepstakes. Any attempt to damage any website of RTM, or tamper with or undermine the legitimate operation of the Sweepstakes, is a violation of these Official Rules as well as criminal and civil laws. RTM reserves the right to seek remedies and damages from any responsible individual to the fullest extent permitted by law. In the event any portion of this Sweepstakes is compromised by any virus, bugs, non-authorized human intervention or other causes beyond the control of RTM which, in the sole opinion of RTM, corrupts or impairs the administration, security, fairness or proper play of the Sweepstakes, RTM reserves the right, at its sole discretion, to suspend or terminate the Sweepstakes. In no event will more prizes be awarded than the one listed above. 9. LIMITATION OF LIABILITY: By entering, entrants (a) agree to these Official Rules, and the decisions of RTM, which shall be binding and final in all respects; and (b) acknowledge that RTM has not made nor is in any manner responsible or liable for any warranty, representation, or guarantee, expressed or implied, in fact or in law, relating to the prize. By participating, the winner releases RTM, its respective officers, directors, employees, affiliates, subsidiaries, Marketing Partner, advertising, promotion, fulfillment, marketing agencies, public relation firms, consultants or contractors from any and all liability, claims or actions of any kind whatsoever for injuries, damages or losses to persons (including death) and property which may be sustained in connection with the receipt, titling, registration, emissions compliance, ownership, possession, acceptance, enjoyment, use or misuse of the prize(s), or arising out of participation in this Sweepstakes, or while preparing for, participating in, and/or traveling to and from taking delivery of the prize or any prize-related activity. RTM expressly disclaims any responsibility or liability for injury or loss to any person or property relating to the delivery and/or subsequent use of the Grand Prize awarded or for the vehicle’s noncompliance with the winner’s state and/or local motor vehicle regulations. IN NO EVENT WILL RTM OR ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, SUBSIDIARIES, ADVERTISING, PROMOTION, FULFILLMENT, MARKETING AGENCIES, PUBLIC RELATION FIRMS, CONSULTANTS OR CONTRACTORS BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING WITHOUT LIMITATION DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, ARISING OUT OF ANY ACCEPTANCE, POSSESSION, USE OR MISUSE OF THE PRIZE AWARDED IN CONNECTION WITH THIS SWEEPSTAKES, INCLUDING WITHOUT LIMITATION, PERSONAL INJURY, DEATH AND/OR PROPERTY DAMAGE, AS WELL AS ANY CLAIMS BASED ON PUBLICITY RIGHTS OR INVASION OF PRIVACY. 10. GENERAL INFORMATION: Any and all disputes in connection with this Sweepstakes will be resolved exclusively in the appropriate courts in Nashville, Tennessee. Should there be a conflict between the laws of the State of Tennessee and any other laws, the conflict will be resolved in favor of the laws of the State of Tennessee. Each entrant waives any and all objections to jurisdiction and venue and hereby submits to the jurisdiction of those courts. Any and all lawsuits or other disputes that arise relating to this Sweepstakes must be filed within one (1) year from the date that the winner is drawn. The failure of RTM to exercise or enforce any right or provision of these Official Rules shall not constitute a waiver of such right or provision. If any part of these Official Rules is held by a court of competent jurisdiction to be invalid or unenforceable, that part will be enforced to the maximum extent permitted by law, and the remainder of these Official Rules will remain fully in force. Entry information provided may be used by RTM to contact entrants and consumers for marketing purposes.
