The Magnaflow Foose Mustang Sweepstakes (“Sweepstakes”) begins at 12:00:01 PM Central Time on May 14, 2009 and ends at 11:59:59 AM Central Time on October 12, 2009. ELIGIBILITY: The Sweepstakes is open to legal residents of the 50 United States or the District of Columbia (excluding Guam, Puerto Rico, and all other U.S. and foreign territories and possessions) and all provinces of Canada (excluding Quebec) (the "Eligibility Area") who are 18 years of age or older at the time of entry and have the ability to enter into valid contracts in their personal jurisdiction of residence. Only individuals may enter; no entry form from any corporation or other entity shall be accepted. To accept the prize, the winner must be a licensed driver and assume responsibility for registration, title, license, taxes, insurance fees and any other options not expressly included. ODDS OF WINNING; PRIZE: Odds of winning are determined by and depend upon the total number of eligible entries received. A purchase will not improve your chances of winning. A total of one (1) Grand Prize will be awarded. The Grand Prize winner will be awarded a 2010 MagnaFlow Foose Mustang. Vehicle will have approximately 3,000 miles. The approximate retail value of the Grand Prize is $50,000 USD. The value of the prize set forth above represents RTM's good-faith determination of the retail value thereof. The prize may not be combined with any other offer. Grand Prize winner will be solely responsible for registering and titling the vehicle and for all applicable taxes, fees, insurance and/or any other expenses associated with acceptance and/or taking delivery of the prize. The winner must take delivery of the prize on December 2, 2009 at RTM Productions, Inc., 130 Southeast Parkway Court, Franklin, TN 37064. By accepting the Grand Prize, the winner waives the right to assert, as a cost of winning said prize, any and all costs of redemption or travel to redeem said prize, and any and all liability that might arise from redeeming or seeking said prize. The winner acknowledges that he or she shall be solely responsible for ensuring the vehicle complies with his/her state and local motor vehicle regulations, including all safety and emissions regulations. 6. PRIZE AWARDING: THE PRIZE WILL BE AWARDED. The prize will be awarded only upon winner validation and verification by RTM. No substitution, transfer or assignment of the prize is permitted. No substitution of the prize will be permitted, except that RTM reserves the right, in its sole discretion, to substitute the prize with either the cash value of the prize that would have been awarded, or a prize of equal or greater value. RTM will use commercially reasonable efforts to contact the winner by mail or email within one day after the actual date of RTM's selection of the winner. If the initially selected winner cannot be contacted, is ineligible, or fails to claim the prize, the prize will be forfeited and an alternate winner will be selected. Where permitted by law, entrants grant RTM and its affiliates the right to use and publish their proper names and states of residence in connection with the Sweepstakes. Acceptance of the prize constitutes permission for RTM and its affiliates to use the winner's name, likeness and biographical information for advertising and promotional purposes without compensation, unless otherwise prohibited by law. The winner will be required to sign an affidavit of eligibility and liability/publicity release of all parties within five (5) days of notification (or return the signed forms within five (5) days of receipt). DISQUALIFICATION: The use of robotic, automatic, macro, programmed or like methods (including without limitation the use of any promotion/sweepstakes subscription, notification, entry or like sites or services that offer sweepstakes entry services "on behalf of" entrant) is strictly prohibited. RTM is not responsible for lost, interrupted or unavailable network server or other connections, miscommunications, failed telephone or computer or telephone transmissions or technical failure, jumbled, scrambled or misdirected transmissions, or other error of any kind whether human, mechanical or electronic. Persons found tampering with or abusing any aspect of this Sweepstakes, as solely determined by RTM, will be disqualified. GENERAL INFORMATION: Any and all disputes in connection with this Sweepstakes will be resolved exclusively in the appropriate courts in Nashville, Tennessee. Should there be a conflict between the laws of the State of Tennessee and any other laws, the conflict will be resolved in favor of the laws of the State of Tennessee. Each entrant waives any and all objections to jurisdiction and venue and hereby submits to the jurisdiction of those courts. Any and all lawsuits or other disputes that arise relating to this Sweepstakes must be filed within one (1) year from the date that the winner is drawn. The failure of RTM to exercise or enforce any right or provision of these Official Rules shall not constitute a waiver of such right or provision.
